Energi Campers France Rental Terms for travel between 01-Jan-2012 and 31-Dec-2012

Please note: If you do not book in the local currency of the country where your rental takes place the payment due dates will change and
your main vehicle rental charges will be payable in full upon confirmation of your booking.
This is to lock in the currency rate of the day you booked on and avoid further currency fluctuations. Some charges like taxes, compulsory fees, extra items may still be payable upon pick up of your vehicle in their local currency.

(Please note, If you book in the local currency of the country where your rental takes place the standard payment terms described under the heading Payment Terms will apply.)

Important information about your rental
On arrival you will be required to sign a rental agreement with the operators of Energi Campers France. Here is a summary of the terms and conditions:

Definitions
The following definitions apply for the Terms and Conditions for Energi Campers France.

-  The Supplier means the operator of Energi Campers France.
-  The Client is also referred to as the hirer (s)

Pick up and drop off
The suppliers departure --> Saturdays
The suppliers return times --> Fridays

Departure and return Sunday and Day off are impossible.

Cautions:
Deposit/Franchise: 2000 € per vehicle for deposit. (750 € if CDW)
Cleaning deposit: 100 per vehicle.(if pets 150 €)

Reservation / Payment:
A non refundable booking deposit is required to secure your motorhome booking. The exact amount is detailed in the breakdown of pricing.
A second stage payment of 50% of rental is taken shortly after booking confirmation as a separate transaction.
The remaining balance is due in full, 4 weeks before the commencement of hire.
After this due date, the supplier reserves the right to cancel the reservation without further notice.
In the event that a reservation is made less than 30 days before departure, payment in full will be due upon reservation.

Cancellation:
The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:
Through written notice by the renting party :
- 73 days before departure: the supplier will refund the renting party half of the second stage payment of 50% of rental received.
- Between 73 days and 31days : the supplier retains its right to keep the full down payment.
- Less than 31days : the full rental price must be paid to the supplier

Travel insurance
The supplier strongly recommends that clients ensure they take out the highest level of travel insurance. In many cases this will cover any losses incurred if you are forced to cancel your booking.

Deposit
A deposit of € 2000 per camper-van will be left on the day of departure (non-cashed cheque or copy of credit card). This will be returned to the renting party the week following return of the vehicle provided that the vehicle and its equipment are returned in good condition at the agreed time and place, subject to deduction of any eventual repair costs which are not covered by the all-risks insurance policy.
If damage to a vehicle is found after its return, the supplier will notify the renting party by letter or email along with a statement from a professional consultant or a photograph of the damage.
The deposit represents the excess for which the renting party is liable in the event of damage or accident. This always remains as € 2000, even when additional insurance is taken out. It is possible to subscribe to a Partial Waiver of the Excess. In this case, the excess payable in the event of an accident for which the rental party is responsible, or without an identified third party, decreases from € 2000 to € 750 per accident. The cost is € 15 per day (minimum payment € 100). The reduction in excess does not apply to damage to the upper parts of the camper-van (roof, hood and, in a general sense, all parts of the vehicle above 2 metres in height), even when partial waiver
of the excess (CDW) has been taken out. Accidental damage to tyres, windscreen, side windows, the car radio, electronic accessories or personal property belonging to the renting party, along with damage to the inside if the vehicle, are not covered by the insurance in any circumstances, even when additional insurance has been taken out.

Cleaning Deposit
Cleaning of the inside and outside of the vehicle is the renting party’s responsibility. In the event of default, a set price of €100, the total amount of the cleaning deposit, will be payable by the renting party.
Four-legged friends are generally welcome, in which case the cleaning deposit will be increased to €150 and full cleaning and hoovering of the inside of the camper-van is obligatory!

Aptitude
Only drivers approved by the supplier will be able to prevail themselves of their rights as an insured party. They must prove their identity, have been in possession of a Light Goods Vehicle driving licence for more than 5 years and be 20 years old minimum (if the driving licence less than 5 years old the deposit/excess is doubled to € 4000)

Insurance:
The supplier's vehicles are covered by an all risks insurance policy which is included in the rental price, with excess, and valid within all EEC countries. Any other destination is subject to prior authorisation in writing from the supplier.
The guarantee applies to the following risks :
- unlimited civil liability in the event of an accident; up to 762,245 Euros in the event of a fire or explosion
- defence and appeal: unlimited / - theft and fire with excess / - natural disasters / - damages resulting from any accidents to the vehicle with excess / - additional fixed cover for the driver and passengers.
The renting party takes the place of the rental agent as regards its rights and position in appeals against third parties for material damage. Any indemnity obtained will firstly be used to reimburse the rental agent for any expenses incurred, the remaining balance going to the renting party.
Subject to the penalty of withdrawal of the insurance, the renting party undertakes :
- To declare any accident, theft or fire, even partial, to the supplier within 24 hours and to the police,
- To set out the circumstances, date, time and hour of the accident in the declaration, along with the names and addresses of any witnesses, the number of the other party's car, the name of their insurance company and their policy number,
- To attach any police or Gendarmerie reports, or clerks' observations to the declaration, if these have been drawn up,
- Not to discuss liability in any circumstances, nor enter into any deal or agreement with any third party in relation to the accident.

The vehicle is only insured for the rental duration indicated on the contract. After this time period, except where an extension has been accepted by the supplier in writing, the renting party will be solely liable for any damage caused and/or suffered by the camper-van.
There is no insurance cover for any drivers who do not hold a valid driving licence or who drive under the influence of alcohol. The supplier cannot accept any responsibility for accidents to third parties or damage to the vehicle caused by the renting party during the rental period if the renting party has deliberately provided the supplier with false information.
In the event of an accident caused by the renting party in the course of which the vehicle is seriously damaged or immobilised for more than five days, the supplier reserves the right to put an end to the rental contract without any reimbursement or compensation. Repair or excess expenses will remain payable.

Exclusions:
Tyres, car radio, electronic accessories (in particular the supplied GPS and/or television), broken windows [windows, windscreen and rear-view mirror], damage to the inside of the camper-van, frost damage, personal belongings, upper parts of the camper-van above 2m, are not covered by the supplier's insurance in any circumstances, even if additional insurance is taken out.

Assistance 24 hours a day :
Assistance to the vehicle and the individuals transported in the event of a mechanical breakdown or accident, covering: towing expenses (up to 228 €), taxi fees to be agreed on a case by case basis, hotel costs (up to 45 € per night per person, for a maximum of 3 nights) and, if appropriate, the cost of returning the vehicle and the individuals transported to the point of rental departure. This assistance is valid in all countries shown on the insurance green card. It operates 24 hours a day and costs 2 € per day. (Compulsory)

Theft :
In the event of a theft, the renting party must make an official theft declaration to the police within 48 hours and return the vehicle's keys. If he fails to do so, the renting party will be held responsible for and charged the total value of the vehicle, plus any immobilisation expenses as determined by the appointed expert and all administration expenses.

Vehicle delivery:
The vehicle is delivered to the renting party in perfect working order and in perfect body condition, with all the normal accessories. An inventory will be taken upon departure. It should be returned in the same condition. If this is not the case, any expenses incurred in returning the vehicle to its original state will be payable by the renting party, up to the total amount of excess applicable.

In July and August, the minimum rental period is one week 7 days from Saturday until Friday). 
The minimum rental period corresponds to the 3-day weekend package.
The contractual duration is imperative. No reimbursement will be made in the event of early return of the vehicle. No extensions will be admitted without the suppliers prior agreement. If this is not obtained, the renting party will expose itself to legal action for misappropriation of the vehicle or abuse of trust.
In the event of the vehicle being returned after the time indicated on the contract, late return penalties will be payable amounting to 1 day's charge per 4-hour delay period.

Use:
The renting party undertakes to use the vehicle only for his personal needs, not to lend or sub-let it, or transport other individuals in return for payment. The renting party undertakes not to let any individuals drive the vehicle other than those approved by the supplier. The approved drivers will act as representatives of the renting party, who becomes entirely responsible for the vehicle as soon as he takes charge of it. The renting party is forbidden from participating in any match, race, rally or any other competition of any nature, as well as any trials or training of this nature. He undertakes not to use the vehicle for illicit purposes or any purposes other than those designated by its
constructor, and not to overload the rented vehicle by transporting more passengers than is indicated on the vehicle registration document. The renting party undertakes not to attach a trailer or any other similar vehicle and not to make any modifications to the vehicle. The renting party undertakes to report any breakdowns or accidents immediately by telephone to the supplier, who will advise them of what to do next. He will not take any initiative in the event of an eventual breakdown or accident unless this is necessary in an emergency. 
Interruption of the holiday due to an accident will give rise to a replacement or proportional reimbursement if the cause of the accident is attributable to the rental agent. Replacement or reimbursement in the event of a breakdown will only apply if the breakdown lasts for more than 24 hours. In the event of a breakdown for which the renting party is clearly responsible, its cost will be deducted from the deposit and no compensation or reimbursement will apply.

Normal mechanical wear and tear is covered by the supplier. Any mechanical repairs needed due to abnormal wear and tear or negligence by the renting party will be chargeable to the renting party. In the event of the vehicle being immobilised, repairs can be effectuated only after written agreement is given by the supplier and in accordance with their directions. These must be shown on a settled invoice. The same applies to any internal adjustments made to the living space (refrigerator, heating, water heater, water pump...). The renting party or the travel agency used by the renting party may not, in any circumstances, claim damages or interest following a delay in vehicle delivery, cancellation of the rental or immobilisation in the event of repairs made during the rental period. In the event of a serious accident or mechanical problem, the renting party must notify the supplier immediately and return to their point of departure at the
time thus set in accordance with the seriousness of the accident or, if not, at least 12 hours (excluding the night) before the return date initially planned, in order to allow for the necessary repairs to be carried out before the arrival of the next client. Damage caused by frost will always be chargeable to the renting party. In the event of damage to one of the tyres due to anything other than normal wear and tear, or disappearance of a tyre, the renting party undertakes to immediately replace the tyre with another with the same specifications and dimensions. The renting party remains solely responsible for any fines, penalties or parking tickets brought against him. The number of kilometres travelled is calculated based on the place of departure and return.

FUEL:
Fuel provision is at the renting party's cost. The vehicle is delivered with a full tank and should be returned by the renting party in the same condition. The renting party should check oil and water levels regularly and oil the vehicle (including the gearbox and axles) and change the motor oil according to the frequencies indicated by the constructor. He will provide evidence of this work by supplying the corresponding invoices, stipulating the number of kilometres shown on the meter at the time of the operation. If the vehicle is delivered new, the renting party undertakes to have the obligatory services carried out by an official agent of the brand. These will be reimbursed in accordance with the supporting documentation provided. The vehicle is delivered with two gas cylinders: one full, one currently being used. Any other gas cylinders required will be at the renting party's cost.

Availability:
The motor-home will be at the client’s disposal following payment of the deposit, the inventory of on-board equipment and the state of the vehicle check, at the agreed pick-up point. Except in the case of an act of God, the motor-home must be returned to the return point at the appointed time.
It is to be returned complete with all equipment listed in the inventory and in the same condition as at departure. The return of the vehicle to a place other than that originally agreed upon or later than agreed, will entail a penalty equal to one day’s or one week’s agreed hire price, depending upon the loss suffered, to be deducted from the deposit.

The client is responsible for the cleaning of the interior and outside if necessary.
The return of the Motorhome in a state of cleanlines different to the departure entails the payment of a penalty deducted from the cleaning deposit fixed at 100 €.

Equipment: The supplier's Motorhomes are all equipped with a hob, fridge, pressurised water system, hot water, heating, WC, toilet facilities, shower and full range of crockery, radio, and Motorhomes Services Area Book.  And also France-Passion book : wine producer and farmer Area.

Bedding: pillows + duvet, sheet : matching, one bathroom towel per person
 

Every late return delivery of vehicle entails a penalty of a day or a week's motor-home hire according to the loss incurred. It is deducted from the deposit.

The tarifs do not include fuel consumption. The inventory of the material aboard the motor-home and the state of the vehicle are stated and at the departure and return appointments. The deposit is returned to the user one week after the return of the vehicle.

The return of a motor-home in an inferior state of interior and exterior cleanliness to that of departure entails the payment of a 100 euros penalty.

Liability

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.

Refund Policy
We are committed to providing a quality service and aim for complete customer satisfaction. In the event of cancellation, any refunds or penalties are detailed in the terms and conditions of your selected vehicle that you are asked to read and accept at time of booking. In the event you are unsatisfied with our service, please contact us within 48 hours of placing your booking or request and we will work to resolve any issues and determine if compensation is due. In the event you have completed your rental and are unhappy with your vehicle, we are happy to assist you in seeking compensation from the operator of the vehicle.
